These Terms of Service ("Terms") govern your access to and use of voltark.net and any related services (the "Service"), provided by XIANSANG US LLC ("VoltArk", "we", "us", "our"). By accessing the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using it, you represent that you meet this requirement.

2. Waitlist Registration

When you submit our waitlist form, you authorize us to contact you by email about the VoltArk launch and related offers. You may unsubscribe at any time.

Waitlist registration does not constitute a pre-order, contract of sale, or guarantee of supply. Pre-orders will be handled through our Kickstarter campaign and governed by Kickstarter's terms.

3. Intellectual Property

All content on the Service — including text, graphics, logos, product imagery, code, and the VoltArk and XIANSANG marks — is owned by XIANSANG US LLC or its licensors and protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent, except for personal, non-commercial viewing of the Service.

4. User Conduct

You agree not to:

  • Use the Service in violation of any law or these Terms
  • Submit false information, including fake email addresses
  • Attempt to circumvent security features, scrape the site, or reverse engineer the code
  • Use the Service to send spam, harass others, or distribute malware
  • Misrepresent yourself or impersonate another person

We reserve the right to remove waitlist registrations that appear fraudulent or to refuse Service to any user at our sole discretion.

5. Pre-orders and Crowdfunding Disclaimers

VoltArk is currently in development. Product images and specifications on this site reflect concept renderings and current engineering targets, and are subject to change.

When the Kickstarter campaign launches, pre-orders are governed by Kickstarter's Terms of Use. We will use commercially reasonable efforts to deliver products as described, but timing, specifications, and features may change due to manufacturing, supply chain, or regulatory factors. To the maximum extent permitted by law, neither XIANSANG US LLC nor its officers, directors, or affiliates are liable for such delays or changes.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XIANSANG US LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED USD $100.

8. Indemnification

You agree to indemnify and hold harmless XIANSANG US LLC and its officers, directors, employees, and affiliates from any claim, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms.
